  • Terms of Service
    These Medical Terms of Service (“Medical Services Terms”) govern your use of the medical services, including the Telehealth Services described in Section 10 below (“Medical Services”) provided by Whealthy Psychiatry professional corporations and our affiliated medical services providers (“Whealthy Psychiatry,” “we,” “us,” or “our”). Please read the Medical Services Terms carefully before using the Medical Services. By using the Medical Services, including the Telehealth Services, you agree to be bound by these Terms. Please refer to our Privacy Policy to learn how Whealthy Psychiatry collects, uses, shares, and protects your Protected Health Information (as defined under HIPAA).
  • Please do NOT use the Medical Services, including the Telehealth Services, for emergency or urgent medical matters. For all urgent or emergency matters affecting your health, immediately call 911 or go to the nearest emergency room or urgent care facility.

 

  • Updates to the Medical Services Terms
    We may modify these Medical Services Terms from time to time. We will notify you of material changes by posting the amended terms on the Whealthy Psychiatry website at least thirty (30) days before the effective date. If we have your email on file, we will also notify you by email. If you do not agree with changes, discontinue using the Medical Services before the effective date. Continued use after the effective date indicates acceptance of the updated Terms.
  • Your Financial Responsibility; Assignment of Benefits
    You agree to pay Whealthy Psychiatry all applicable charges at prevailing rates for Medical Services provided to you. This includes complementary and alternative services provided by a Whealthy Psychiatry Provider. You authorize Whealthy Psychiatry to charge your chosen Payment Method. If payment fails, you agree to pay all amounts upon demand. Whealthy Psychiatry is currently out-of-network with all health insurance plans and does not submit claims on your behalf.
  • Appointments: Missed/Late Cancellation
    Cancellations must be made more than 48 hours before the appointment time. Missed appointments or no‑shows will be billed at 100% of the session cost.
  • Permission to Treat
    You give permission to our Providers to medically care for you. You may withdraw consent by ceasing to seek Medical Services from Whealthy Psychiatry. As part of providing Medical Services, your Protected Health Information may be released to an online personal health record and communicate with Whealthy Psychiatry’s healthcare team electronically per our Privacy Policy.
  • Service Termination
    You may terminate your use of the Medical Services at any time by discontinuing their use. We may also terminate your use at our discretion, including for illegal conduct, abusive behavior, or non‑payment. Termination notices will be sent to your provided email or mailing address.
  • Mental Health Services Disclaimer
    Mental health services may involve discussing sensitive life aspects, which can trigger uncomfortable feelings. Should you experience increased distress or thoughts of harming yourself or others, you agree to notify your provider immediately so appropriate support can be provided. Your provider may use standardized psychological symptom questionnaires to assist in diagnosis and track progress, and will review these with you as needed.
  • Consent to Electronic Communications
    You agree that Whealthy Psychiatry may send legal disclosures, Medical Services Terms, HIPAA Privacy Notices, updates, policies, and other communications via email or secure messaging. You consent to receive such communications electronically and agree to keep your contact information current. To opt out of non-essential electronic communications, follow unsubscribe links or email us. Note: You cannot opt out of mandatory communications such as billing notices or updates to these Terms.
  • Disclaimers
    TO THE MAXIMUM EXTENT NOT PROHIBITED BY LAW, EXCEPT IN CASE OF NEGLIGENCE OR WILLFUL MISCONDUCT, Whealthy Psychiatry and its affiliates, providers, employees, officers, directors, or agents will not be responsible for any loss or damage, including personal injury or death, resulting from use of or inability to use the Medical Services. Our Medical Services are intended only within the states we serve. Accessing them from outside those states is at your own risk and subject to applicable local laws.
  • Limitation of Liability
    TO THE MAXIMUM EXTENT NOT PROHIBITED BY LAW, Whealthy Psychiatry and its affiliates, providers, employees, officers, directors, or agents will not be liable for any consequential, exemplary, incidental, special, or punitive damages (including lost profits or substitute service costs) arising out of or in connection with the Medical Services, whether based on contract, warranty, tort, or other legal theory, even if informed of the possibility of such damages. Some jurisdictions do not allow exclusion or limitation of certain damages, so such exclusions may not apply to you.
  • Telehealth Services and Permission
    Whealthy Psychiatry provides psychiatric Telehealth services (the “Telehealth Services”). You consent to receive emails or electronic communications regarding your care, which may include Protected Health Information. You understand that virtual encounters via phone, email, video, or other means may involve automated tools and care by various providers (e.g., Nurse Practitioners, Therapists). You consent to Whealthy Psychiatry and its Telehealth Providers processing your personal and medical data. You may withdraw consent by ceasing use of Telehealth Services. Telehealth may not be suitable in all cases due to data quality or condition complexity; you may be required to seek in-person or emergency care if needed.
  • General Provisions
    These Terms constitute the entire agreement related to your use of the Medical Services, superseding all prior agreements. We may change, suspend, or discontinue any Medical Services or partnerships at any time and will attempt to notify you in advance. We are not liable for any modification, suspension, or discontinuation. These Terms do not confer third-party beneficiary rights, and you may not transfer your rights or obligations without our consent. Whealthy Psychiatry may assign rights in connection with a merger, acquisition, sale of assets, or by law. Provisions that by their nature should survive termination will continue after termination.
